If an arrest warrant is issued against you, this is a very serious matter and will mean that the police are actively looking for you. The warrant gives them the legal power to arrest you, so it is important that, if you think a warrant may exist, you seek legal advice as soon as possible.
It is crucial that you have an expert defence lawyer with you when you are being interviewed by the police as sometimes procedures are not followed which can result in the accused or suspect being released without charge. If the police want to speak to you about an allegation you have a number of rights that you MUST remember:

    You have the right to remain silent. The only information that you must provide to the police is your name, address, date of birth, nationality and place of birth. For everything else, you can make NO COMMENT.
    You have the right to a consultation with a lawyer by phone or in person at the police station. This is where McGovern Reid can help. Tell the police that you want to speak to us if you are at the police station and they MUST call us. We will then speak to you by phone or, if necessary, attend at the police station with you.
    You can make NO COMMENT during the interview with the police. You are not required to say anything.
    After the interview, there are several options available to the police. They can release you due to insufficient evidence or pending further enquires. If you are charged by the police you may be (1) taken to court the next court day; (2) released on an undertaking to attend court on a later date or (3) released with a police report being sent to the Procurator Fiscal.
    If you have not already asked for McGovern Reid to be contacted, then you should make contact with us as soon as you are released. If you are kept in custody to appear in court, you should ask the police to contact us.
    If you are released with a court date or are reported to the Procurator Fiscal contact us immediately and we will give you the advice that you need.
